LoopedIn, Inc.
Scope and Definitions
(a) These Terms of Use (“Terms”) govern your access to and use of the AI Platform (“Platform”) provided by LoopedIn, Inc. (“Company,” “we,” or “us”). By accessing or using the Platform, you agree to be bound by these Terms.
(b) “AI Platform” refers to the software, algorithms, and AI models provided by the Company, including any updates, modifications, or enhancements thereto.
(c) “User” or “you” refers to any individual or entity accessing or using the Platform.
(d) “Content” refers to any data, information, text, images, or other materials uploaded, downloaded, or created using the Platform.
Eligibility and Account Creation
(a) You must be at least 18 years old or the age of majority in your jurisdiction to use the Platform.
(b) To access the Platform, you must create an account by providing accurate and complete information, including your name, email address, and payment details (if applicable).
(c) You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
User Conduct and Prohibited Activities
- (a) You agree to use the Platform only for lawful purposes and in compliance with these Terms and all applicable laws and regulations.
(b) You shall not use the Platform to:
(i) Engage in any illegal, fraudulent, or misleading activities;
(ii) Infringe upon the intellectual property rights of others;
(iii) Engage in hate speech, harassment, or discrimination;
(iv) Transmit spam or malicious code; or
(v) Attempt to circumvent the Platform’s security measures.
(c) You are solely responsible for the Content you create, upload, or share using the Platform.
Intellectual Property Rights
(a) The AI Platform, including its software, algorithms, and AI models, is the intellectual property of the Company and protected by copyright, patent, trademark, and other intellectual property laws.
(b) Users retain full ownership of the Content they create using the Platform and may use AI-generated content commercially.
(c) Users must respect the intellectual property rights of others when using the Platform and shall not use third-party intellectual property without permission.
Publicity Rights
(a) The Company reserves the right to include the User's organization as a customer in promotional material unless the User submits a written request to opt out.
(b) Users may request removal from promotional materials by submitting a written request to support@loopedin.ai. The Company will process such requests within 30 days.
Feedback and Feature Suggestions
(a) Users may submit feedback, comments, and suggestions for improving the Platform.
(b) By submitting feedback, Users grant the Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, modify, and incorporate such feedback into the Platform without compensation.
Privacy and Data Protection
(a) The Company intends to comply with GDPR and other relevant data protection laws but has not yet achieved full compliance.
(b) By using the Platform, you consent to the collection, use, and sharing of your personal data as described in the Privacy Policy.
(c) The Company implements reasonable security measures to protect user data but cannot guarantee the absolute security of such data.
(d) Users may choose to delete their generated content from the Platform.
(e) The Platform is intended for use in the United States, and the Company does not guarantee compliance with data protection laws outside the U.S.
Payment and Billing
(a) The Platform operates on a per-user monthly subscription pricing model. Users may also incur additional charges if they exceed their tier thresholds.
(b) Users are responsible for providing accurate payment information and for paying all fees and charges associated with their use of the Platform.
(c) The Company reserves the right to modify its pricing and billing practices at any time, with reasonable notice to users.
(d) No refunds will be issued for terminated paid accounts, as the service operates on a month-to-month basis. This policy is strictly enforced to avoid disputes.
Termination and Suspension
(a) Users may voluntarily terminate their account at any time by following the instructions provided on the Platform.
(b) The Company reserves the right to terminate or suspend user accounts for violations of these Terms, illegal activity, or any other reason, at its sole discretion. Users will receive a warning 30 days prior to suspension.
(c) Upon termination, users must cease using the Platform, and the Company may delete any Content or data associated with the terminated account.
Limitation of Liability
(a) The Platform is provided “as is” and without warranties of any kind, express or implied.
(b) The Company does not guarantee 24/7 uptime and reserves the right to restrict or suspend access for maintenance, security updates, or other reasons.
(c) The Company shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising out of or in connection with the use of the Platform.
(d) The limitations of liability set forth in this section shall not apply to damages resulting from the Company’s gross negligence or willful misconduct.
Modifications to Terms of Use
(a) The Company reserves the right to modify these Terms at any time, at its sole discretion.
(b) Users will be notified of any material changes to the Terms at least 30 days in advance via email or through a notice posted on www.loopedin.ai/legal.
(c) Continued use of the Platform after the effective date of the modified Terms constitutes acceptance of the changes. Users will not be required to re-accept the updated Terms.
AI Bias Disclaimer
(a) The AI models used in the Platform are subject to limitations, including potential biases inherent in machine learning algorithms.
(b) The Company makes no guarantees regarding the accuracy, reliability, or fairness of AI-generated outputs and disclaims responsibility for any decisions made based on such outputs.
